Thank you for purchasing TIMBERWALK Floors; we wish you many years of true enjoyment: Residential Guarantee Applications Warranty disclaimers The foregoing is in lieu of all other warranties expressed or implied, including but not limited to, the implied warranties of merchantability and fitness for a particular purpose, except as covered by Common Law. The manufacturer shall not be liable for loss of use or any other Incidental or consequential costs, expenses or damages incurred by the original purchaser. This warranty gives you specific rights and you may also have other rights that may vary from State to State. It should be read in Conjunction with TIMBERWALK General Terms and Conditions of Sale (available upon request). Important the covered person must provide proof and date of purchase, original purchase price and that he/she is the Warranties are limited to the original purchaser, and may not be assigned or transferred. In the case where a builder makes the purchase, this warranty is limited to the owner of the floor 1year after practical completion of works. If a flooring product from TIMBERWALK Floors should fail to meet the Terms of the Warranty, TIMBERWALK Floors and the manufacturer, at its discretion, will either supply replacement of the defective product, or refund the purchase price of the defective product prorated over the remaining life of this limited warranty. Cupping and doming, refers to the reasonably uniform convexing or concaving shape across the width of the surface of boards installed. Cupping and doming, whilst extremely uncommon, are caused by factors relating to installation or the installation environment. As they are outside the control of the manufacturer, they are specifically excluded from this warranty. This warranty is exclusive. It covers the repair or replacement of defective materials only. It does not cover labour costs. Installation of the replacement products will be at the buyer’s expense. The above remedy is the customer’s only and is an exclusive remedy for claims under this warranty. This guarantee only applies to installations performed by a licensed Timber Floor installer-Carpenters., you must maintain your floors as per the instructions set down in the conditions under “Care & Maintenance of Your Floor,” cleaning agents must be approved by TIMBERWALK FLOORS. Products not approved may cause damage and your floor may be void of its warranty. This warranty applies to Residential Use Only. This guarantee is limited to either replacing or repairing the damaged section of the floor; the final decision rests with TIMBERWALK FLOORS. NOTE: TIMBERWALK FLOORS. is a natural product, small splits in the surface of the floor can occur. This is known as surface checking and should be considered normal. In addition, small surface blemishes in the coating or gaps that appear between boards as a result of seasonal or environmental changes can also be expected. Note that gloss variation, surface checking, scratches, chips, gaps or small blemishes are NOT considered as major failure. They are considered part of purchasing a natural TIMBER floor. These definitions are not intended to reduce or diminish the statutory rights of any purchaser.

<h4<Surface Finish-Twenty Five Years Warranty

TIMBERWALK FLOORS, warrant that the surface finish has been applied under strict quality control systems by the manufacture. The warranty excludes any indentations and surface damages which have been caused through lack of care, or the lack of proper maintenance, negligence, misuse, walking with stiletto heels or stones on shoes, nails, spiked shoes, water damage, chair casters, other liquids or chemicals, abrasives of any kind not mentioned and insufficient pre-protection. The damaged section must be visible and must cover at least 10% of the floor area. gloss variation between boards, colour variation between boards or irregular nodes (timber knots) are considered a natural part of TIMBER flooring and are therefore excluded from this warranty.

The reduction of the sheen-gloss is not considered surface wear.

Product thought to be defective by the installer should be returned to your dealer for inspection and possible replacement prior to installation. Installation implies acceptance of the appearance-related claims, relating to features visible at purchase, once the products are installed. Under no circumstances shall TIMBERWALK FLOORS be liable or in any matter responsible for any claim, loss or damage arising from the purchase, use or inability to use its products or form of special, indirect, incidental, or consequential damages, including without limitation, loss of profits, emotional, multiple, punitive or exemplary damages or attorney’s fees. In no event shall TIMBERWALK FLOORS. be obliged to cover the costs of old or new materials other than TIMBERWALK FLOORS. brand product, and any warranty thereto is limited to the warranty, if any, provided by the original manufacturer. In no event shall Rhino Timber Floors liability exceed the amount it actually received upon distribution for the defective materials at issue. This warranty gives you specific legal rights and you may have other rights, which vary, from state to state.

Some states do not allow the exclusion or limitation of implied warranties or incidental, consequential, emotional distress or punitive damages, and in such events, the exclusion or limitations set forth above shall be deemed altered to the least extent possible to be enforceable.
